These Terms and Conditions ("Terms") govern your access to and use of the evvo platform ("Service"), operated by RuleTek Ltd ("Company", "we", "us", or "our"), a company registered in England and Wales. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
The Service is intended for use by educational institutions, including kindergartens and schools, and their authorised staff members. By using the Service, you represent that you are authorised to accept these Terms on behalf of your institution and that your institution will comply with all applicable laws and regulations.
To access the Service, you must register for an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at sales@evvotek.com of any unauthorised use of your account.
You may use the Service solely for your institution's internal purposes in connection with managing student enrollment, family communications, and related administrative functions. You must not use the Service to transmit any unlawful, harmful, or offensive content, or for any purpose that violates these Terms or applicable law.
In the course of using the Service, you may input personal data relating to students, parents, and guardians. You acknowledge that you are the data controller for such personal data and that you are solely responsible for ensuring compliance with applicable data protection laws, including the UK GDPR and the Data Protection Act 2018. RuleTek Ltd acts as a data processor and will process personal data only in accordance with your instructions and our Data Processing Agreement.
The Service, including all software, designs, text, graphics, and other content, is owned by or licensed to RuleTek Ltd and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service in accordance with these Terms. You must not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written consent.
Certain features of the Service may require payment of fees. All fees are as set out in your order form or subscription agreement and are exclusive of applicable taxes. RuleTek Ltd reserves the right to modify pricing upon not less than 30 days' written notice. All fees paid are non-refundable unless otherwise stated or required by applicable law.
To the fullest extent permitted by law, RuleTek Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of the Service. In no event shall our aggregate liability exceed the fees paid by you in the twelve (12) months preceding the event giving rise to the claim.
We strive to maintain the Service's availability but do not guarantee uninterrupted or error-free operation. We reserve the right to suspend or discontinue the Service, or any part thereof, at any time for maintenance, upgrades, or any other reason, with or without notice, provided we will use reasonable endeavours to minimise disruption.
Either party may terminate the Service agreement in accordance with the terms of your subscription agreement. RuleTek Ltd may immediately suspend or terminate your access to the Service if you breach these Terms. Upon termination, your right to use the Service will cease immediately, and we may delete your account and data in accordance with our data retention policy.
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service following notice of any changes constitutes your acceptance of the revised Terms.
